Can i get H1B for 2010? iam a software programmer.?

recently USCIS stated that 2010 H1 cap received only 45k petitions so i think comapanies r not willing to hire H1 workers... and more over US GOVT stated to prefer american professionals rather than H1 workers... so what is the chance for me to get a h1b visa. let say if i go tru backdoor, are consultancies willing to process h1 visas?
